LEGAL INFORMATION

The seller is the company Miriade spa with registered office in Piazza Dei Martire n. 30 - 80120 Naples - VAT number 07631370637 and tax code 03371431218 REA - NA - 610434 (hereinafter "Miriade").
The sales process on the Site was implemented in full compliance with the legislation on distance selling, electronic commerce and, in particular, the Consumer Code (Legislative Decree 6 September 2005, n. 206).
The following provisions establish the general conditions of sale (hereinafter, for brevity, "Terms and Conditions") that regulate the contractual agreement between Miriade and the customer (hereinafter "Customer") regarding the remote sale on Italian territory of the products offered on the Site.
The Customer must request information and send communications by contacting Miriade customer service at the email address help@miriade.com or to the postal address of Miriade - Interporto lotto C A19-A20-A21 80035 Nola (NA).

OFFER ASSESSMENT

The acceptance and confirmation of the order are completed by entering the requested data in the following phases:

  1. Adding the selected products to the cart;
  2. Cart validation;
  3. Indication of personal data + choice of delivery method;
  4. Pre-contractual information;
  5. Acceptance of these Terms and Conditions;
  6. Select payment method.

Up to the stage before payment, you can modify your order by clicking on the cart icon at the top.
In case of payment by credit card, the definitive acceptance of the order on the Website by the Customer occurs with the insertion of the card details (credit card number and expiry date).
In case of payment on delivery, the final acceptance by the Customer implies the commitment to receive and pay for the goods.
In case of payment with PayPal, the final acceptance by the Customer occurs through the insertion of the requested data on the PayPal site and is considered complete only after the "adequate" status by the PayPal operating system.

PRODUCTS AND PRICES

  1. Products
    The products subject to the contractual agreement governed by the Terms and Conditions are all the items visible on the Website, in particular leather products, textile products, bags, shoes and accessories (hereinafter referred to as "Products"), shown on the Website at the time of ordering. It is possible to order only the products shown on the Website. In the case of promotions with a specific duration, the Customer is required to pay attention to the time limits and validity of the same.

  2. Rates
    The selling price of the Products offered on the Site, indicated in euros (unless otherwise indicated), is the one in force at the time of registration of the order by the Customer. The prices include the VAT rate applicable on the day of the order and any variation of this rate will be automatically applied to the price of the Products sold by Miriade on the Website.
    Prices do not include shipping costs, which are added to the price of the Products purchased and vary depending on the amount of the order. Shipping costs will be specified before the order is confirmed by the Customer, therefore before proceeding with payment.
    The sales prices of the Products may be modified by Miriade at any time, it being understood that the price applicable to the contractual agreement with the Customer will be the one in force and indicated on the Website at the time of registration of the order by the Customer.

  3. Product Features
    The Products subject to the contractual agreement governed by these Terms and Conditions are all the items visible on the Site at the time of the order; in compliance with articles 52 and 53 of the Consumer Code, the Miriade company provides consumers with information on the Products and makes them aware of all the primary characteristics of the Products offered (sizes, colors, composition, description, etc.) and the price, taxes and charges included.
    Before ordering, the Customer has access to the essential characteristics of the Product(s) he/she wishes to purchase on the Website. In addition, the characteristics of the Product will be visible through the photos published on the Website which represent the articles as accurately as possible. The photos are not part of the contractual agreement between the parties. The Customer acknowledges that the photos of the Product displayed on the Website are for reference only. There may be changes due to the processing of the photos.
    The availability of the Products sold on the Website is updated automatically but, if the Website is visited by multiple users at the same time, simultaneous purchases may cause a Product indicated as available to be just out of stock. In these cases, a notification will be sent to the Customer's email address and the amount charged to the Customer (price of the product and related shipping costs, if applicable) will be refunded in accordance with the methods described in the "Payments" section.
    Miriade reserves the right to modify the assortment of products based on the obligations arising from the relationships with its suppliers.

  4. Specific conditions of offers on Miriade.com
    For special sales, especially end-of-season sales, promotional sales, below-cost sales and other operations, the discount applied will be distributed proportionally to the value of each item.

THE ORDER

The insertion of the purchase order on the Site implies the total and absolute prior knowledge of these Terms and Conditions and their full acceptance. The Customer is required to print and save electronically a copy of these Terms and Conditions.
The Terms and Conditions that apply to the contractual agreement between Miriade and the Customer are those published on the Website www.miriade.com when sending the order.

Miriade reserves the right to change the Terms and Conditions at any time.
Each order placed by the Customer via online payment will be taken into consideration by Miriade only after acceptance of the payment and confirmation by the payment gateway.

Miriade will send the Customer one or more order confirmation emails containing all the order details and the information required by law:

  • Detailed indication of the price, the payment method used, the chosen payment instrument, the delivery costs, the delivery terms;
  • Information and instructions on the right of withdrawal and the related costs and legal guarantees;
  • Additional pre-contractual information required by law;
  • A summary of these Terms and Conditions.
    The sale is considered completed only after the confirmation email has been sent to the Customer, the product availability has been validated and the relevant price has been paid by the Customer.
    The order can be modified up to the stage preceding payment, by clicking on the cart icon at the top.
    Once confirmed, the order can no longer be modified online, neither in terms of items nor in terms of delivery address, except for the Customer's right of withdrawal in any case.
    After making the payment, the Customer can cancel the order within 24 hours by contacting customer service.
    Miriade recommends its Customers to keep the order confirmation email in electronic or paper format.
    Miriade sells the Products on its Site only to retail and end consumers.
    Any order that is clearly not a retail sale and in general any fraudulent or presumably fraudulent order will be considered invalid by Miriade.
    It is specified that the offer of products and/or Services on the Site is aimed exclusively at natural persons of age or minors between the ages of 16 and 18 with the authorization and/or under the supervision of a parent or guardian and/or to legal persons, who do not intend to sell and/or market them in the context of any commercial activity; therefore, Miriade reserves the right not to accept orders from subjects - including Resellers - who, due to the quantity of products ordered, frequency and continuity of orders and frequency of the same or other elements that will be evaluated by Miriade from time to time, are presumed to intend to sell and/or market them to third parties in the context of their own commercial activity.
    The resale or transfer for any commercial or professional purpose of the products purchased on the Site is expressly prohibited.

Miriade reserves the right to refuse orders from:
(i) a Customer with whom Miriade has or has had legal disputes;
(ii) a Customer who has been involved in any type of fraud and in particular in fraud relating to credit card payments;
(iii) a Customer who has provided false, incomplete or inaccurate identification data;
(iv) Customers in arrears;
(v) If it emerges that the Customer is purchasing the Products for the purpose of reselling or transferring them for commercial or professional purposes.

ORDER CONFIRMATION AND STORAGE

The order number will be communicated to the Customer after the acceptance of the transaction by the bank or after clicking on the "cash on delivery" payment method. The order confirmation will be sent by email and will contain the Terms and Conditions and the methods relating to the right of withdrawal.

In case of unavailability of one or more Products, Miriade will send an email to the Customer to inform him and will refund the price of the Product and shipping costs within 10 days.

Orders are stored on our server for 10 years from the last order. At any time, the Customer can access the order details by sending an email to help@miriade.com .
To access the order form, the Customer must log in to their account area. Instructions for accessing the order form will be included in each order confirmation email.

To receive the invoice, the Customer must request it at the time of ordering by sending an email to pay@miriade.com .

PAYMENTS

Miriade.com accepts the following payment methods:

  • Credit card
  • PayPal
  • Scalapay
  • Google Pay

*Other payment methods are not accepted by Miriade.com
Payment must be made by the Customer at the time of ordering and the accepted currency is the Euro.

CREDIT CARD

The Customer can pay for the order by credit card, a simple and safe method for online purchases. Miriade accepts the following credit cards: Visa, MasterCard, American Express, Maestro and PostePay.
Miriade guarantees maximum security thanks to the most used encryption solution on the market. In fact, by clicking on the credit card owned, the Customer will be redirected to the payment site supervised by the company AXERVE that implements the SSL security standard.
As part of fraud prevention, Miriade uses 3D Secure payment for orders paid with Visa and MasterCard credit cards. 3D Secure (also called Verified by Visa or Mastercard SecureCode) is a payment system with authentication that allows you to strengthen security during online purchases. At the time of payment, the customer's bank verifies the identity of the cardholder before confirming the transaction.
After entering the card details, the customer is redirected to the website of his bank where he is asked to identify himself.
Each bank has its own procedure, which may for example require your date of birth, a code received via SMS or to answer a personal question.
For security reasons, Miriade reserves the right to request a photocopy of the Customer's identity document and/or credit card for purchases made by credit card (front - only the first 4 and last 2 digits - and back).

CREDIT CARD SECURITY

All transactions are processed in a secure manner to ensure maximum security of the personal data of Miriade.com Customers. The financial information of the Miriade.com Customer (credit card number, credit card expiration date and other personal data) will be processed exclusively by AXERVE and will never be stored and/or known by Miriade.com.

PAYPAL

If the Customer has a PayPal account, he/she can pay for the order directly online. After choosing the payment method, the Customer will be redirected to the PayPal website. The Customer will have to enter his/her data and proceed with the payment. With PayPal, the Customer's bank details are never communicated to Miriade. PayPal protects the Customer's card number with an encrypted system.
Miriade reserves the right to ship the goods only to the destination address indicated on the verified PayPal account.

Credit Card Fraud Control
As part of fraud prevention, Miriade uses 3D Secure payment for orders paid with Visa and MasterCard credit cards.

In order to ensure the security of payments made by Customers on the Website, Miriade has the right to verify the personal data provided by the Customer and to take the necessary measures (request for supporting documents or cancellation of the order). Miriade verifies that the person who owns the bank account to which the expenses are refunded is the same person who placed the order, to avoid fraudulent use of bank cards.

The Customer guarantees to Miriade that he/she has all the necessary authorizations to use the payment method chosen at the time of order registration.

Miriade reserves the right to suspend or cancel any order and/or delivery, regardless of type and status, in the event of non-payment of the amount due by the Customer, payment incidents, fraud or attempted fraud relating to the use of the Website.

After ten days from the date of the invoice or from the notification of refusal of the bank payment or any other type of payment, the legal interest rate with an increase of three points will be applied to the amount due.

The shipment of any new order may be suspended in case of delay in payment of the previous order.

DELIVERY TERMS AND TIMES

Miriade.com ships to Italy with the Crono Express services of the SDA Express Courier of Poste Italiane, and worldwide with DHL ECONOMY and EXPRESS. Valentino brand products can only be shipped to the following countries: geographic Europe, former USSR countries. These products absolutely cannot be shipped to Canada and the United States.

  • Delivery in 3-5 working days throughout the country.
  • Home delivery or collection at one of approximately 10,000 authorised post offices or Punto Poste
  • Flexible delivery (Saturday, evening, by appointment, delivery to neighbor, etc.).
  • Possibility to choose from numerous accessory services to customize delivery according to your needs
  • In case of absence of the recipient, the services guarantee two automatic delivery attempts
  • The shipment can then be collected at the post office
  • Free storage at a post office in case of absent recipient
  • Customize your delivery with Choose You

Delivery is made, upon request of the Customer, to:

  • The recipient's address (Home delivery)
  • A post office with a Poste Reserva service or mailbox (Poste Reserva)
  • One of the Puntoposte points (collection point and/or locker).
    The list of Post Offices that provide the Fermo Posta service and the list of Puntoposte collection points are available on www.poste.it .
    Choose You is the new Poste feature that offers an alternative delivery model. By following the link provided through the notification with the shipment status, the recipient can choose one of the enabled options: delivery on another date, delivery to another address, delivery to a neighbor, collection at the post office, PuntoPoste or PuntoPoste Locker, delivery to a safe place, holiday storage.

Parcel Pickup Options:

  • HOME DELIVERY: You can follow the status of your shipment at any time with the tracking code that we will send you: enter this code in the "Track shipments" tab on the site www.poste.it , or with the email that will directly inform you of the status of the shipment. Has the order been shipped but you have indicated an incorrect address? Do you want to change it for other reasons? Are you not available for collection? No problem: we have the CHOOSE YOU service. You can access the service directly from your shipment and you can change and customize the delivery, receiving your order where and when you want. To find out how it works, click on Choose You. For any assistance you need, you can call the toll-free number 803.160.

  • COLLECTION POINTS: It is the widespread network of Poste Italiane that includes: authorized post offices (over 12,000 throughout Italy), participating commercial establishments (about 3,000) (e.g. tobacconists) that offer parcel collection and shipping services and, for small parcels, also Lockers (about 350) - 24/7 self-service automated kiosks - (how the Locker works). To collect from:
    or authorized post offices, providing the operator with the code sent by Poste via email
    or COLLECTION POINTS, provide the operator with the PIN code (sent by Poste via email)
    or LOCKER, enter the PIN code (sent by Poste via email) on the screen.

DELIVERY TIMES

Delivery is approximately within 3-5 working days from shipment in most Italian locations. Delivery times vary depending on the destination of the shipment and can be verified in the appropriate section of the site www.poste.it and/or toll-free number 800.160.000. Fermoposta shipments are also available on Saturdays, during post office opening hours. Check the post offices authorized for the Fermoposta service and the locations and opening hours of the Lockers and Pickup Points of the PuntoPoste network.

Delivery attempts
In the event of the recipient's absence, the service guarantees two automatic delivery attempts. In the event of failure to deliver on the first attempt, the forwarder provides a notice to inform the recipient that a second delivery will be attempted on the following working day. In the event of the recipient's absence on the second attempt, the forwarder will leave a notice in the mailbox with the details of the post office where the recipient will be able to collect the package within the following 10 working days, including Saturdays.

TRACEABILITY

You can check the delivery status at any time using the tracking service. After sending the order you will receive a confirmation message and/or an email with the tracking code to check and/or reschedule the shipment. Alternatively, you can check the delivery status in real time in the "My Account" side section. Smart Alert informs you of the status of the shipment by sending you a message, via SMS and/or email.

PASSAGE OF RISK OF LOSS OF GOODS ON DELIVERY

Pursuant to art. 63 of the Consumer Code, paragraph I, as amended by Legislative Decree 21/2014, in contracts in which the seller is required to provide for the shipment of the goods, the risk of loss or damage to the goods, for reasons not attributable to the seller, is transferred to the consumer only when the latter, or a third party designated other than the carrier, physically takes possession of the goods.

Returns and Refunds

Miriade.com wishes to guarantee the complete satisfaction of its Customers, offering them the possibility of returning one or more items and receiving a refund equal to the price of the returned items. The return must take place under the responsibility of the Customer within 30 days of delivery and only on condition that the returned items are intact and unused.

RETURN POLICY

To return one or more items to Miriade.com, the Customer must comply with some mandatory conditions:

  1. Items showing signs of use or wear will not be accepted and will be returned to the customer.
  2. Items must be returned in the same condition as when shipped to the customer and must be wrapped and packaged properly.
  3. All other labels on the item, whether fabric or pendant, must never be removed from the item.
  4. The goods to be returned must be delivered exclusively to the Courier within 30 days from the delivery date.
  5. The customer who wishes to make a change of size, color or item, of equal or greater amount, must follow the "Return Procedure", see below, and place a new order on the site.

In case of failure to comply with the conditions listed above, Miriade.com reserves the right to not accept the delivered goods and to return them to the Customer at the latter's expense.

RETURN PROCEDURE

The Customer is required to follow the instructions on the form attached to the package or the return and refund instructions contained in the package. It is possible to send parcels to authorised post offices or to one of the authorised Puntoposte (list published on the website www.poste.it ) or via the home collection service (Pick-up), which can be programmed by calling the toll-free number 803.160.
The Customer can check the status of their shipments through the free online tracking service, available on the website www.poste.it starting from the working day following the day of acceptance or through the Contact Center at 800.160.000 or through the Technological Solutions used by the Customer.
Shipping is at the Customer's expense and risk: Miriade.com is not responsible for any loss or damage caused by inadequate packaging or delays in delivery. Items must be returned in the same packaging in which they were received or in the same type of packaging.
All returned items will be examined by Miriade.com staff who will verify compliance with the conditions and considerations listed in the return procedure. Miriade.com reserves the right to charge additional costs if these are necessary to ensure the resale of the returned items. These amounts will be determined after evaluating the conditions of the returned items and communicated to the Customer.
The Customer is required to use exclusively the Crono Reverse shipping label for the shipment of returns. It is understood that the following returns, if sent, will not be accepted, with consequent charging of the related costs to the Customer:

  1. With documentation other than Crono Reverse;

  2. 30 days from receipt of the goods, for any reason.

  3. Pursuant to Article 1381 of the Civil Code, the Customer undertakes to:
    a) send consignments to authorised post offices or request the Pick-up service;
    b) pack the parcel in accordance with the instructions contained in the Shipping Guidelines and the Crono Reverse packaging instructions;
    c) clearly and correctly indicating the address of the Sender and the Recipient on the external envelope of the package;
    d) accompany each package with the appropriate shipping label, prepared in compliance with these GTC.

    Sorting and delivery operations are carried out on the basis of the data indicated by the Sender on the shipping label; it is therefore essential that the Sender uses the shipping label sent by Miriade.com, completed and correct, including the information relating to the name and surname of the Sender and the Recipient and the address of both, including the postal code (and apartment or floor number if necessary to identify the delivery point). It is recommended to indicate the Sender's telephone number, to allow Customer Care to contact him in case of need. Poste Italiane guarantees correct delivery only if the address is complete and correct. The postal code is an essential element to guarantee delivery: automatic sorting is based on the on-screen reading of the postal code, which must be correctly indicated on the shipping label. For large cities, divided into postal areas, the specific postal code must be indicated and not the generic one (e.g. 50134 and not 50100).
    The name and address of the Sender and the Recipient, including the postal code, must also be correctly indicated on the outer envelope of the package, or on a firmly glued shipping label. For greater security, it is advisable to indicate the data of the Sender and the Recipient (and possibly the shipping label number) also on the box. This information is purely indicative. Only the Customer is responsible for the packaging, labeling and wrapping of the packages delivered to Poste Italiane. The Customer - Sender is in any case responsible for any damage caused by packaging defects, even if not detected at the time of acceptance.
    Poste delivers from Monday to Friday, excluding Saturdays and holidays. Poste undertakes to deliver according to a delivery target of four working days following the day of dispatch, excluding Saturdays and holidays, in accordance with the Postal Services Charter, published on the website www.poste.it . For returns sent for acceptance beyond the terms established by authorized post offices, or Puntoposte, delivery is deferred to the day following acceptance. Poste reserves the right to change the delivery standards of parcels in the event of adverse weather conditions, natural disasters, strikes or any other fact or event not attributable to it, giving written notice to the Customer within the working day (Monday to Friday) following the day on which the event occurred, without this entailing additional costs and charges. Compliance with delivery targets is also subject to compliance by the Sender with the weight and size requirements and the correct preparation of the packages.

REFUNDS

If the return procedure has been carried out correctly, in compliance with all the conditions indicated, the Customer will receive an email accepting the return. The refund due will be made through the same payment method used for the purchase order.
There may be a few days between the date of receipt of the return and the date of the refund.
Refunds are made in the same currency as the purchase. Any losses caused by financial fluctuations will not be refunded.

RIGHT OF WITHDRAWAL PROVIDED FOR BY LAW

Pursuant to Articles 52 et seq. of the Consumer Code (Legislative Decree 6 September 2005, n. 206), the Customer has a period of 14 days from receipt of the Products purchased online to withdraw from the contract without having to provide any reason.

Legal guarantee of conformity

Products that present defects of conformity at the time of delivery, reported to Miriade within 30 days of delivery, can be returned or a replacement can be requested if the product is available.

In case of termination of the contract, the Customer will be refunded the entire amount paid for the purchase, including shipping costs.
Retention of title
Miriade reserves full ownership of the Products until delivery and payment of the full price, including expenses and taxes.
Intellectual property
All elements of the Website subject or not to registration of intellectual property rights (photos, Product details, descriptions, layouts, etc.) are the exclusive property of MIRIADE and may not be used. All drawings, models, trademarks, texts (visual or sound), comments, works, illustrations, images displayed on the Site www.miriade.com are protected by copyright, trademark, image rights and any other applicable intellectual property rights.

These elements are the property of MIRIADE or its partners. Any type of reproduction or representation not authorized by MIRIADE entails the civil and criminal liability of the author. The user who owns a website and/or a blog who wishes to publish a link to the homepage of the Site www.miriade.com must necessarily request prior authorization from MIRIADE.
Links to the Site using "framing" or "in-line linking" techniques are formally prohibited. In any case, each link, even if tolerated, must be removed upon simple request by MIRIADE.
Dispute Resolution
In case of problems with a product purchased on the Mirade.com Site, the Customer can contact our customer service directly at the following email address help@miriade.com .

In the event of disputes arising from contractual agreements with MIRIADE, the parties undertake to find an amicable agreement before taking any legal action.

For all disputes relating to purchases made by Customers on the Site, the Court of their domicile will be competent. The applicable law is Italian law.

Pursuant to Article 49, paragraph 1, letter v), of Legislative Decree 6 September 2005, n. 206 (Consumer Code), we inform you of the possibility of using the Joint Conciliation Procedure. After 45 days from the complaint presented to the company without receiving a response, it is possible to activate the aforementioned Procedure.
